These Terms of Service ("Terms") govern your access to and use of the Fabteriors website, including the purchase of furniture, accessories and related services through our online store.

By accessing the website, creating an account, placing an order or otherwise using our services, you agree to be bound by these Terms and the policies referred to within them.

Please read these Terms carefully before placing an order.

For the purposes of these Terms, "Fabteriors", "we", "us" and "our" refer to Fabteriors, while "you" and "customer" refer to the person accessing the website or purchasing our products.

 

2. Acceptance of These Terms

By using the Fabteriors website or placing an order, you confirm that:

·        You have read and understood these Terms;

·        You agree to comply with these Terms and applicable laws;

·        The information you provide to us is accurate and complete; and

·        You are legally capable of entering into a binding transaction under applicable law.

 

If you do not agree with these Terms, please do not use the website or place an order.

 

3. The Fabteriors Website

Fabteriors provides an online platform through which customers can view and purchase furniture and related products.

We may modify, update, suspend or discontinue any part of the website or its functionality from time to time.

We do not guarantee that the website will always be available, uninterrupted or completely free from technical errors.

We may temporarily suspend access where necessary for maintenance, security, updates or other operational reasons.

 

4. Product Information

We make reasonable efforts to ensure that product information displayed on the website is accurate and up to date.

Product information may include:

·        Images

·        Dimensions

·        Materials

·        Finish

·        Colour

·        Price

·        Availability

·        Production lead time

·        Care information

 

Natural Materials & Handcrafted Products

 

Fabteriors uses natural wood and other materials and incorporates traditional and handcrafted techniques.

 

Natural materials may naturally vary in:

 

·        Grain

·        Colour

·        Texture

·        Knots

·        Markings

·        Pattern

·        Tone

 

Handcrafted products may also contain subtle variations arising from the individual nature of the making process.

These characteristics are part of the nature of natural and handcrafted furniture and should not automatically be considered defects.

 

Product photographs/ videos are intended to provide a reasonable representation of the product. Differences in lighting, photography and individual screen settings may result in minor differences in appearance.

 

5. Product Availability

Products displayed on the website are subject to availability.

A product being displayed on the website does not guarantee that it will remain available for purchase at all times.

Fabteriors may discontinue, modify or temporarily suspend the availability of a product.

Where a product becomes unavailable after an order has been placed and Fabteriors cannot fulfil the order, we will communicate with the customer and provide an appropriate resolution in accordance with applicable law and our Returns & Refund Policy.

 

6. Product Categories

Products may be offered as:

 

Ready Stock

Products that are currently available and can proceed towards fulfilment subject to order confirmation and quality checks.

 

Made to Order

Products that are produced after an order has been placed.

 

Bespoke / Custom

Products made or modified according to customer-specific requirements.

The applicable production and delivery timeline may differ depending on the category.

 

7. Custom & Bespoke Orders

Where Fabteriors agrees to create a customised or bespoke product, the customer will be responsible for confirming the agreed specifications before production begins.

These may include:

 

·        Dimensions

·        Material

·        Finish

·        Colour

·        Design modifications

·        Other agreed specifications

 

Once production of a bespoke or customised product has commenced, cancellation, modification or return may be subject to specific conditions communicated at the time of order.

Fabteriors will not be responsible for variations that arise naturally from the use of natural materials or handcrafted processes where such variations are consistent with the agreed product specifications.

 

8. Prices

All product prices displayed on the website are in Indian Rupees (INR).

Fabteriors reserves the right to change product prices at any time.

However, a price change will not affect an order that has already been accepted and confirmed by Fabteriors, except where correction is required due to an obvious pricing or technical error.

GST is not included in the prices displayed on the website and is added at the time of the checkout.

 

9. Pricing & Display Errors

Fabteriors makes reasonable efforts to ensure that product information and prices are displayed accurately.

Occasionally, an error may occur due to technical, typographical or other reasons.

If a material pricing or product-information error is discovered after an order has been placed but before it has been fulfilled, Fabteriors may contact the customer to explain the error and provide the available options, subject to applicable law.

 

10. Placing an Order

When you place an order through the website, you are making an offer to purchase the selected product(s) under these Terms.

After placing an order, you may receive an order acknowledgement.

An order acknowledgement does not necessarily constitute final acceptance of the order.

Fabteriors may review the order before confirming fulfilment.

 

An order will be considered accepted when Fabteriors confirms the order for fulfilment or otherwise communicates acceptance to the customer.

 

11. Order Cancellation

Cancellation of an order will be governed by Fabteriors' separate Returns, Refunds & Exchanges Policy.

The ability to cancel may depend on whether:

·        The product is ready stock;

·        Production has begun;

·        The product is made-to-order;

·        The product is bespoke/customised; or

·        The product has already been handed over for delivery.

 

Customers should contact Fabteriors as soon as possible if they wish to cancel an order.

 

12. Payment

Fabteriors currently accepts online payments through the payment methods made available at checkout.

Payments may be processed through third-party payment gateway providers.

The payment gateway may independently process and verify payment information.

An order will generally proceed to fulfilment only after successful payment confirmation.

If a payment fails, is reversed or cannot be verified, Fabteriors may suspend or cancel the order until the payment issue is resolved.

 

13. Delivery

Fabteriors offers delivery across India, subject to product and location considerations.

Standard delivery is currently offered free of charge across India, subject to the terms of Fabteriors' Shipping & Delivery Policy.

Estimated timelines are generally:

·        **Ready Stock:** 3–4 weeks

·        **Made to Order:** 3–4 weeks

·        **Bespoke / Custom:** 3–4 weeks

 

These are estimated timelines and are not guaranteed delivery dates unless expressly confirmed by Fabteriors.

14. Third-Party Delivery Partners

Fabteriors uses independent third-party logistics and delivery partners.

Once an order has been handed over to the appointed delivery partner, physical transportation and delivery operations—including routing, scheduling, delivery attempts and physical handling during transit—are managed by the respective delivery partner.

Fabteriors does not control the delivery partner's day-to-day logistics operations.

However, Fabteriors remains available to assist customers and coordinate with the delivery partner where reasonably possible.

Customers should refer to the Shipping & Delivery Policy for further details.

 

15. Delivery Access

Customers are responsible for ensuring that furniture can safely reach the intended location.

Before ordering large furniture, customers should consider:

·        Doorway dimensions

·        Stairways

·        Corridors

·        Lift dimensions and weight capacity

·        Parking and vehicle access

·        Building restrictions

·        Society restrictions

Upper-floor delivery through stairs or lifts is not included in standard delivery unless expressly confirmed otherwise.

Assembly and installation are also not included in standard delivery unless expressly stated

 

16. Returns, Refunds & Exchanges

 

Returns, refunds, exchanges and cancellations are governed by Fabteriors' separate Returns, Refunds & Exchanges Policy.

 

The availability of a return or refund may depend on:

·        The nature of the product;

·        Whether it is ready stock, made-to-order or bespoke;

·        The reason for the return;

·        Whether the product has been used or altered;

·        Whether damage occurred before or after delivery; and

·        Other conditions set out in the applicable policy.

 

Nothing in these Terms is intended to remove or restrict any mandatory consumer rights available under applicable law.

 

17. Warranty

Fabteriors offers a 5-Year Warranty Programme for eligible furniture, subject to the applicable Warranty Policy.

The warranty covers eligible manufacturing and workmanship defects affecting structural integrity or intended function under normal residential use, subject to inspection and the exclusions stated in the Warranty Policy.

The warranty is separate from Fabteriors' Care & Restoration Policy and Buy-Back Policy.

A warranty claim, warranty repair or warranty replacement does not constitute a return, refund or buy-back and does not create, increase, reset or extend any buy-back value or eligibility.

Customers should refer to the 5-Year Warranty Policy for complete details, subject to applicable law.

 

19. Care & Restoration

Fabteriors may provide care and restoration services for eligible furniture.

Such services may include:

·        Surface restoration;

·        Polishing;

·        Repair;

·        Refinishing;

·        Maintenance; and

·        Other approved restoration work.

 

Availability, pricing and eligibility will depend on the product and condition.

All restoration work begins only after the customer has approved the proposed service and paid the applicable charges.

 

Any shipping, transportation, collection or related logistics required for Care & Restoration will be borne by the customer, wherever applicable.

20. Buy-Back Programme

Fabteriors may offer a Buy-Back programme for eligible furniture.

Buy-back is subject to the applicable eligibility criteria, detailed photographic submission, product condition, inspection and valuation process.

Where eligible, Fabteriors may offer a buy-back value of up to 50% of the applicable original purchase value, depending on the condition of the furniture sent back. The actual value may be lower and is not guaranteed.

Buy-back value is provided solely as Fabteriors Store Credit, valid for 2 years from the date of issuance, subject to the applicable Buy-Back Policy.

Any shipping, transportation, collection or related logistics required to return or transfer furniture for buy-back will be borne by the customer, wherever applicable.

The Buy-Back Programme is separate from the Warranty Programme and Care & Restoration Programme.

21. Intellectual Property

All content on the Fabteriors website, including but not limited to:

·        Brand name

·        Logos

·        Product names

·        Photographs

·        Product descriptions

·        Graphics

·        Illustrations

·        Videos

·        Website design

·        Text

·        Original artwork

·        Other creative material

is owned by or licensed to Fabteriors and may be protected by applicable intellectual-property laws.

 

You may not reproduce, copy, modify, distribute, publish, sell or commercially exploit Fabteriors content without prior written permission.

 

Unauthorised use of the Fabteriors brand, imagery or content is prohibited.

 

22. User Conduct

You agree not to:

·        Use the website for unlawful purposes;

·        Attempt to gain unauthorised access to the website or its systems;

·        Interfere with website functionality;

·        Introduce malicious software or code;

·        Scrape or systematically copy website content without permission;

·        Misrepresent your identity;

·        Use another person's information without authorisation;

·        Submit fraudulent orders;

·        Attempt to interfere with payment or checkout systems.

 

Fabteriors reserves the right to restrict or terminate access where there is reasonable evidence of misuse, fraud or unlawful activity, subject to applicable law.

 

23. Third-Party Services

Fabteriors uses third-party services to operate the website and fulfil orders.

These may include:

·        Shopify

·        Payment gateway providers

·        Logistics and delivery providers

·        Analytics services

·        Advertising platforms

·        Communication providers

·        Technology and hosting providers

Your use of third-party services may also be subject to their respective terms and policies.

Fabteriors is not responsible for the independent policies or practices of third-party services that it does not control.

Fabteriors' collection and use of personal information is governed by our Privacy Policy.

By using the website, you acknowledge that your personal information may be processed as described in that policy for purposes including order fulfilment, payment processing, delivery, customer support, website operation and other legitimate business purposes.

 

25. Website Accuracy

We endeavour to maintain accurate information on the website.

However, Fabteriors does not warrant that:

·        All website information will always be complete;

·        All product information will always be error-free;

·        The website will always be available;

·        All website functionality will operate without interruption; or

·        All content will always be current.

Fabteriors may correct errors and update information at any time.

 

26. Limitation of Liability

To the extent permitted by applicable law, Fabteriors will not be liable for indirect, incidental, special or consequential losses arising from circumstances beyond its reasonable control or from the misuse of the website or products.

However, nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable Indian law.

Nothing in these Terms is intended to exclude or restrict mandatory consumer protections or statutory rights.

 

27. Events Beyond Our Reasonable Control

Fabteriors will not be responsible for failure or delay in fulfilling an obligation where such failure or delay results from circumstances beyond its reasonable control, including:

·        Natural disasters

·        Extreme weather

·        Government restrictions

·        Strikes

·        Transportation disruptions

·        Civil disturbances

·        Infrastructure failures

·        Widespread technical failures

·        Other unforeseen events affecting operations

 

Where reasonably possible, Fabteriors will inform affected customers and take reasonable steps to resume performance.

 

28. Suspension or Termination

Fabteriors may suspend or restrict access to the website where reasonably necessary for:

·        Maintenance

·        Security

·        Investigation of misuse

·        Prevention of fraud

·        Compliance with law

·        Other legitimate operational reasons

Termination or suspension of access will not affect rights or obligations relating to orders already accepted, except where permitted or required by applicable law.

Fabteriors may update these Terms from time to time.

30. Governing Law & Jurisdiction

These Terms are governed by and shall be construed in accordance with the laws applicable in India.

Subject to any mandatory statutory jurisdiction or dispute-resolution mechanism that cannot lawfully be excluded or restricted, the competent courts in the State of West Bengal shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms, the Fabteriors website, orders, products or services.

Nothing in this clause is intended to prevent a customer from exercising any mandatory statutory right to approach a consumer commission, tribunal, authority or other forum having jurisdiction under applicable law.
